This four-week online course aims to provide anti-corruption and compliance practitioners with a dynamic, step-by-step discussion on how to address corruption in public procurement – both practically and proactively. 

The IACA Fighting Corruption in Public Procurement course will address the main issues in this field, from concepts of corruption, special compliance issues in procurement, best practices internationally in checking corruption, and emerging issues, globally, in public procurement. 

Learning objectives

By the end of this course, participants should be able to:

  • Recognize the causes of corruption in public procurement, and the public policy models for integrating anti-corruption with best value in procurement.
  • Understand the common processes in public procurement internationally – how the systems work, and where corruption risks emerge.
  • Critically assess the anti-corruption institutions in the participant’s home country, using the UN Office of Drugs & Crimes (UNODC) assessment metrics.
  • Prepare an anti-corruption and compliance plan, including risk assessment and implementation, for a vendor working in many national markets.
  • Address corruption in a private supply chain, for example “commercial bribery”
  • Work with the institutional solutions used to address corruption, including bid challenges, audits, ethics codes, oversight, and tender boards.
  • Understand how agencies and vendors respond to corruption, through disqualification and debarment, criminal prosecution and open contracting.
  • Identify emerging best practices in anti-corruption, around the world, and recommend how they might be applied to the participant’s home country.

Structure and Workload

Approximately 36 Hours (9 hours per week)

The course is delivered online, and includes pre-recorded lectures, synchronous live lectures, self-assessments, individual assignment and online discussions. It is adapted specifically for professionals in full-time work.

This course is for

Procurement officials, attorneys, academics, managers, anti-corruption investigators, compliance managers, etc., seeking to enhance their understanding of corruption issues in public procurement.

Lecturers

Christopher Yukins

Christopher Yukins serves as co-director of the government procurement law program at George Washington University Law School, in Washington, D.C.  He has taught there (in both traditional classrooms and online) on public contract formations and performance issues, bid protests and claims litigation, state and local procurement, anti-corruption issues, foreign contracting, procurement reform, and comparative and international law.  He has testified on issues of procurement reform and trade before committees of the U.S. Congress and the European Parliament.  He is a visiting professor at the Université Paris - Nanterre, where he lectures annually, and has taught at government agencies and academic institutions around the world, including the International Anti-Corruption Academy (Austria), King’s College, London, Stellenbosch University in South Africa, and Stockholm University.  He was a contributing editor to the UN Office on Drugs and Crime manual, Guidebook on Anti-Corruption in Public Procurement

He is a faculty advisor to the Public Contract Law Journal, is a member of the editorial board of the European Procurement & Public-Private Partnership Law Review, and is on the advisory board of The Government Contractor (Thomson Reuters)He was an advisor to the U.S. delegation to the working group on reform of the United Nations Commission on International Trade Law (UNCITRAL) Model Procurement Law.  Together with his colleagues, he runs a colloquium series (both live and webinars) at The George Washington University Law School.  In private practice, Professor Yukins has been an associate, partner and counsel at leading law firms; he is currently counsel to the firm of Arnold & Porter. 

Max Kaiser

Max Kaiser is the founder of the Center for Integrity and Ethics in Business CIEN http://integridadcien.org.mx/ UN advisor on issues of combating corruption and government procurement. He is a member of the ACAD (Anti-Corruption Academic Initiative) of the Office of the United Nations Office on Drugs and Crime and member of the Faculty of IACA (International Anti-Corruption Academy). He graduated in law from the Autonomous Technological Institute of Mexico (ITAM) and an MA in Latin American Comparative Politics at the London School of Economics (LSE). Currently he teaches Constitutional Law and Administrative Law at ITAM. He is the author of the book "The Fight Against Corruption in Mexico, An Unresolved Assignment.” He was Under Secretary for Public Procurement and Administrative Responsibilities, which is the last post he held in a 12-year period as a public servant.

He drafted the citizen’s initiative that gathered 634,000 signatures to become the new Administrative Responsibilities Law, and was part of the drafting team that wrote the other six laws that created the new National Anticorruption System in Mexico.
